Terms of sales

These Conditions of Sale apply to the sale of works of art by the Martín de Vidales Art Gallery. These General Conditions shall prevail over these Conditions of Sale in the event of a discrepancy between the two.

Please read these conditions carefully before placing your order with Martín de Vidales. By placing your order online with Martín de Vidales Art, you agree to be bound by these conditions.

1. Our contract

When you place your order, we will send you a message confirming receipt of your order. Likewise, we will inform you about the shipment of the acquired works. You can however modify your order before the order enters the shipping process.

You agree to receive invoices for your purchases electronically. Electronic invoices will be provided in PDF format. For more information about electronic invoices and how to receive them on paper, please contact us at arte@mardevidaart.com

2. Right of withdrawal of 14 days, exceptions to the right of withdrawal, voluntary return guarantee and legal guarantee of conformity

LEGAL LAW

Unless one of the exceptions described below applies, you may cancel your order without reason within 14 calendar days from the day you, or a third party you have indicated (other than the carrier), receive the works bought.

Martín de Vidales Art does not assume ownership of the returned artwork until it is received at the return address. Martín de Vidales Art reserves the right, at its discretion, to refund the amount of the work without requiring its return. In such case, the ownership of the work whose price had been reimbursed will not pass to Martín de Vidales Art.

EFFECTS OF WITHDRAWAL

Martín de Vidales Art will reimburse you the price of the work and discounting the ordinary one-way shipping costs corresponding to the cheapest shipping option that we offer, no later than 14 days following the day on which we receive the aforementioned communication. Martín de Vidales Art will use the same means of payment that you would have used for the initial transaction, unless another means is expressly agreed upon.

You will bear the direct costs of returning it and will be responsible for the decrease in value of the returned goods due to the handling of the items.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to the delivery of:

• Works that do not allow their return due to reasons inherent to the work.

• Works that can deteriorate or expire quickly.

• Audiovisual works if you had unsealed them after delivery;

• Goods made to your specifications or clearly personalized;

• Audiovisual works if you had consented to the execution at the time of delivery and without your withdrawal being possible from that moment;

3. Prices and availability

All prices include legally applicable taxes (example VAT).

We include information on the website about the availability of the available works, detailing it on the information page in each case. or.

In some cases, we may not be able to confirm a specific delivery date when you place your order. In these cases, we will provide you with our best estimate.

4. Work information

The technical data of the work is specified on the web page next to each one.

5. Customs Information

Works purchased for delivery in a country outside the European Union require the buyer to pay import duties and taxes, which may be collected at the time the package reaches its destination. Any additional amount due to customs clearance will be borne by the buyer.

6. Our responsibility

Martín de Vidales Art.es is not responsible for (i) any losses that were not attributable to any breach on its part, (ii) business losses (including lost profits, income, contracts, anticipated savings, data, loss goodwill or unnecessary expenses incurred), or (iii) any indirect or consequential losses that were not reasonably foreseeable by both parties at the time the contract for the sale of the work was formalized between both parties.

If the work is acquired as a "consumer", you will be entitled to the guarantee of conformity provided for in the legislation according to which the delivered good must be in accordance with the contract, and to which the seller is legally bound (Legal Guarantee).

Martin de Vidales Art.es will not be responsible for compliance with the obligations set forth in the Commercial Guarantee offered by third parties.

7. Applicable Law

These conditions will be governed and interpreted in accordance with Spanish legislation

8. Modification of the conditions of sale

We reserve the right to make changes to our website, our policies and our terms and conditions, including these Conditions of Sale, at any time.

9. Waiver

In case of breach by the client of these Conditions of Sale, and even when Martín de Vidales Art may not exercise any rights available to him at that time, Martín de Vidales Art may make use of such rights and actions on any other occasion. in which you could breach these Conditions of Sale.
